Three Indonesian laws matter for any agen properti running an automated WhatsApp workflow in 2026.
UU No. 27/2022 — Personal Data Protection Law (UU PDP). Indonesia's comprehensive data-protection law was passed in October 2022 with a two-year transition period, and enforcement became active in October 2024. UU PDP is closely modelled on GDPR: it defines personal data (data pribadi) and specific personal data (data pribadi spesifik — including health, biometrics, financial); it requires a lawful basis for processing (Article 20 — consent, contract, legal obligation, vital interest, public interest, legitimate interest); it requires informed and specific consent under Articles 21-22; it imposes controller and processor obligations; it gives data subjects rights of access, correction, erasure, and objection to processing. Administrative sanctions include fines up to 2% of annual revenue and, for serious offences, criminal penalties. A property-listing enquiry that captures a prospective buyer's phone number, name, and property preferences is personal-data processing under UU PDP. Marketing broadcasts to opted-in prospects require explicit consent under Article 22.
UU ITE — Electronic Information and Transactions Law (as amended 2024). The amended UU ITE governs the general framework for electronic communication and transactions in Indonesia, including WhatsApp messages that constitute contract-relevant communication. Practically, an agen who sends property information over WhatsApp is producing an electronic record that has evidentiary weight under UU ITE — the agent should keep records, avoid misleading representations, and be careful about what constitutes an offer or acceptance in the message stream.
POJK — OJK marketing conduct rules where mortgage products are involved. If the estate-agent's workflow crosses into mortgage promotion (a common pattern in Indonesia where agents work with bank partners on KPR — Kredit Pemilikan Rumah — home loans), the OJK's consumer-protection regulations apply to any communication that promotes a specific bank's financial products. Marketing messages tied to KPR must be truthful, must not omit material terms, and must respect the recipient's opt-out. Formal financial-product distribution requires the agent or their partner to hold the appropriate OJK licence category; a pure property-referral relationship without financial-product distribution is generally outside OJK's direct scope, but any KPR promotion sent from an agent's WhatsApp does trigger the conduct rules.
Beyond the three laws, the ATR/BPN framework governs actual property transaction execution — land title (sertifikat hak milik / SHM, hak guna bangunan / HGB), the PPAT notary process, and the BPHTB tax on property transfers. Those are outside the WhatsApp-automation surface but frame what the workflow can and cannot promise buyers.
Indonesian estate agents typically operate against a small set of active property portals for listing distribution and lead generation.
Rumah123 (rumah123.com) is one of the largest property-listing portals in Indonesia, owned by 99 Group (Southeast Asia property tech). It covers sale and rental listings across residential, commercial, and land categories, with agent packages, feature-listing options, and its own lead-management interface.
Rumah.com (rumah.com) is the other major listing portal in Indonesia, historically the local brand of PropertyGuru (Singapore) which was acquired by EQT in 2024; the Indonesian operation continues under the Rumah.com brand. It covers similar listing categories and provides agent tools and buyer-lead capture.
Lamudi Indonesia (lamudi.co.id) is part of the Lamudi group operating across emerging-market countries in Asia and Latin America. It is smaller in Indonesia than Rumah123 / Rumah.com but remains an active listing surface for many agents, particularly in Jabodetabek (Jakarta metro area) and secondary cities.
OLX Properti — the property vertical of the OLX Indonesia platform, which is operated by 99 Group under the OLX brand licence for Indonesia. Unlike OLX in some other countries which has been shut down, OLX Indonesia remains active for classifieds including property.
Direct social channels — Indonesian agents also lean heavily on Instagram, TikTok, and WhatsApp-based referral networks alongside the formal portals; a lot of transactional traffic in the property market comes from personal networks and WhatsApp broadcasts to community groups, not from portal search.
All of these portals expose the agent's contact number to interested buyers; buyers commonly initiate contact via WhatsApp regardless of what channel the listing was on. The WhatsApp inbox is where a substantial share of Indonesian property-agent workflow actually happens, which is why WhatsApp Business Platform tools have traction in this market.

These are utility-category templates under Meta's July 2025 pricing, priced per template at Meta's utility rate for Indonesia. The trigger is usually the calendar event created when the agent schedules the viewing; the template sends automatically off that event.
Marketing-template broadcasts to opted-in prospects — new-listing notifications to buyers who have expressed interest in a specific area or property type, price-change alerts, open-house invitations. These are marketing-category templates, priced per template at Meta's higher marketing rate. Under UU PDP Article 22 and UU ITE, the recipient must have given specific consent to receive marketing WhatsApp messages, the consent record must be kept, and every message must include a working opt-out.
What a WhatsApp Business Platform tool does not replace: portal listing management (the agent still lists on Rumah123, Rumah.com, Lamudi, OLX Properti through those portals' own agent interfaces); property CRM proper (a dedicated real-estate CRM handles pipeline, deal stage, commission calculation, and transaction closing better than a WhatsApp inbox); the compliance work under UU PDP (the consent record, the DPA equivalent, the responsible-person appointment).
What it should not attempt: sending KPR mortgage promotions without OJK-compliant conduct posture (truthful, complete, opt-out honoured); sending clinical-style advice on legal or tax questions around property purchase (SHM vs HGB, BPHTB rate, PPAT costs) that should come from a PPAT notary or tax adviser.
The WhatsApp Business Platform pricing shift that took effect on 1 July 2025 moved billing from per-24-hour-conversation to per-template-message across three categories: utility, marketing, and authentication. For Indonesian estate agents, the practical effect is that outbound business-initiated messages now cost per message at Meta's Indonesia rate, while inbound-triggered replies inside the 24-hour service window remain free.
A rough cost picture for a mid-size Jakarta brokerage — 200-400 inbound WhatsApp buyer enquiries per month, 100-200 viewings scheduled, 20-40 marketing broadcasts to a small opted-in prospect list — comes out as: platform subscription (via the vendor of choice, typically USD 30-150/month for a small-brokerage tier), plus Meta template cost dominated by the utility-template line for viewing reminders and confirmations. Marketing-template cost scales with the size of the opted-in prospect list; for a small list this is a minor line, for a large aggressive-outbound list it can dominate.
Business replies to buyer-initiated conversations remain free within the 24-hour service window. This makes the inbound-heavy workflow of most Indonesian property agents relatively cost-efficient — the expensive messages are the proactive broadcasts, not the responses.
UU PDP entered active enforcement in October 2024 after its two-year transition period from October 2022 passage. Most guides written before that transition ended treat WhatsApp marketing to Indonesian buyers as low-friction; that has changed.
For an estate-agent WhatsApp workflow, the practical UU PDP posture:
Data collection at first contact. When a prospective buyer messages the agent from a Rumah123 or Rumah.com listing enquiry, the agent's initial response should either explicitly reference the portal's privacy notice (both major portals publish one) or provide a short, plain-Indonesian statement that the agent will use the buyer's contact information to respond to the enquiry and — separately — that the agent would like consent to send future property matches. Consent for future marketing must be separate from consent to reply to the current enquiry.
Consent record. A per-buyer record showing when consent was given, what specifically the consent covered, and through what interface. UU PDP does not prescribe a specific format, but a defensible record is a timestamped log tied to the WhatsApp phone number and the source portal / channel.
Opt-out honouring. Every marketing-category template message must include a working opt-out ("Balas STOP untuk berhenti menerima pesan" is the common Indonesian formulation). The opt-out must be honoured immediately and reliably — not just recorded, but actually removed from the outbound-broadcast list on the vendor side.
Data-processor relationships. The WhatsApp Business Platform vendor the agent uses is a data processor under UU PDP. The agent (as controller) needs a data-processing agreement with the vendor that meets UU PDP Article 51 requirements — instruction-only processing, security obligations, breach notification, sub-processor rules. Reputable WhatsApp platform vendors publish a standard DPA; the agent needs to actually sign and retain it.
Responsible-person / data-protection officer. UU PDP requires a controller of personal data at scale to appoint a data-protection officer where processing is regular and systematic, or where sensitive personal data is processed. For a small brokerage, the responsible person is usually the principal broker or a designated staff member; the appointment should be documented internally.
For a solo agen properti or a small brokerage (1-5 agents) in Indonesia in 2026: use the property portals (Rumah123, Rumah.com, Lamudi, OLX Properti) as the listing distribution and lead-generation surface; use WhatsApp Business (the free consumer-tier app) or the WhatsApp Business Platform via a modest-tier vendor as the buyer-contact channel; keep the consent posture tight from day one (UU PDP is now enforced, and the transition-period leniency has ended); and treat the transactional workflow (SHM verification, PPAT engagement, BPHTB payment) as sitting outside the WhatsApp layer entirely.
For a mid-size brokerage (5-30 agents), the WhatsApp Business Platform value grows significantly: shared inbox, assignment rules, template management, marketing broadcasts to a properly consented list. The vendor selection matters — an Indonesia-based vendor (Qontak, for example) will have more relevant defaults for UU PDP and local support; a global vendor (Wati, Respond.io, Bird, Twilio, 360dialog, BossBot) may have broader features but requires more work to configure for Indonesian regulatory realities. All of them connect to the same underlying Meta API and produce essentially the same buyer-facing experience.
For a large brokerage or a developer sales team, the WhatsApp platform is one component in a broader stack that includes a proper real-estate CRM (for pipeline, commission, and transaction closing), a marketing-automation layer (email, WhatsApp, Instagram DM), and integrations to the portals' agent APIs where available. At this scale, the vendor selection is driven by CRM integration and reporting, not by the WhatsApp inbox itself.
What is not the right answer in any scenario: an aggressive WhatsApp broadcast pattern to a list assembled without proper UU PDP consent, sending KPR mortgage promotions without OJK-compliant conduct posture, or presenting a WhatsApp AI as a substitute for the agent's own due diligence on SHM, HGB, or transaction execution.
